Hearing and Decision

1. How does the hearing process work?

  • The appellant is requested to submit a documentation on the disciplinary action.
  • The appellant’s documentation will be reviewed by the Commission
    (when necessary, on-site visits are made for investigation).
  • The date of the hearing is set and notified to both the parties; the hearing is held on that date.
  • Both parties must be present at the hearing, during which they are given the opportunity to make statements.
The Commission may question both parties in the course.

2. How is the decision made?

  • The decision is made within 60 days from the date the appeal is received (30 additional days can be provided). The types of decision include abatement, rejection, cancellation, admission, confirmation and order obedience.
  • A party such as a teacher, a school corporation or a private school manager (excluding public organizations) may file a lawsuit against the decision of the Examination Committee as prescribed within 30 days from the date of receipt of the decision.
